In these conditions, “Owner” means Calm iT Services Ltd; “Hirer” means the person or company who has ordered from the Owner the equipment as detailed.
i. Any equipment hired is the direct responsibility of the Hirer whilst it is in their possession. The Hirer agrees to insure the equipment against loss, theft or damage at their own expense for the period of hire. The Hirer also agrees to take appropriate care to ensure that security of the equipment whilst it is in their possession.
ii. All equipment hired by the Hirer should be installed and operated by competent personnel. The Hirer undertakes to use the Goods at all times in accordance with the instructions and methods (if any) and/or for the purposes recommended by Owner. No responsibility can be accepted by the Owner for damage to property or personnel whilst equipment is on hire to the Hirer.
iii. Title to all hired equipment shall remain with Calm iT Services Ltd at all times.
iv. All hire equipment is accepted as working at the time of delivery.
v. The Hirer shall not sell or part with possession or control of the equipment at any time during the period of hire.
vi. Hire equipment will not be taken out of Great Britain without prior written authorisation from Calm iT Services Ltd.
vii. Under no circumstances will the Hirer add to, alter, modify, adapt or interfere with in any way any item of equipment hired, nor will they allow any other party to do so. Note, flesh tone lav mic concealment using the technique described in the following link (https://www.youtube.com/watch?v=351DxQghbh0&t=779s) is permitted provided the mic is returned derigged and in good condition.
viii. The Hirer will be charged for any damage, repairs and/or maintenance to the equipment that arises through misuse or negligence.
ix. The Hirer will notify Calm iT Services Ltd immediately should the equipment be stolen, lost or damaged in any way.
x. The Hirer agrees to pay the Owner full, new replacement costs for any equipment that is lost, stolen or damaged in any way and is beyond economic repair.
xi. The Hirer will be subject to extra and continuing hire charges for any period that the equipment is retained beyond the agreed hire period if any hire equipment is returned incomplete.
xii. Unless otherwise agreed all monies are due and payable within 30 days of date of invoice. Without prejudice to the Owner’s other rights, we reserve the right to charge interest to be added to any late payment from the due date for payment at the rate of 2% per calendar month above the base rate from time to time of the Bank of England until full payment has been received.
Government mandated venue closures, eg for COVID-19, shall incur no penalties and pro rata (Transparent Discounts) hire charges (excludes shipping costs) shall be refunded. Orders cancelled (eg for cast sickness) 7 days prior to the commencement of hire are charged in full, orders cancelled 14 days prior to the commencement of hire are charged at 50% of the hire rate.
The Owner accepts no liability for the loss, damage, injury or death to any company, firm or person arising in connection with the use by the Hirer of the Equipment including without prejudice the failure of the Equipment.
A day is one 24 hour period or part thereof. A week is one 7 day period or any part thereof. A month is one 28 day period or any part thereof. Delivery and Collection charges are not included in the rental rate.
Upon termination prior to the completion of the agreed term the hirer shall return the Equipment to the address which the Owner shall specify and the Hirer will pay to the Owner by way of agreed damages.
